1. Introduction

Welcome to PetFellow.org ("PetFellow," "we," "us," or "our"). We are a comprehensive online platform dedicated to connecting the pet community in Bangladesh. Our services include social networking, pet profiles, a marketplace for pet goods, booking systems for veterinary, caregiver, and foster services, community building, and facilitating pet adoptions, rescue, and welfare activities.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("user," "you," or "your") and PetFellow. By accessing, registering for, or using our website and services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. User Eligibility and Accounts

To use our Services, you must be at least 18 years old and capable of entering into a binding contract. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Core Principles and User Conduct

PetFellow is built on the principles of responsible pet ownership and animal welfare, in alignment with the Animal Welfare Act, 2019 of Bangladesh. As a user, you agree to:

• Promote Animal Welfare: Not engage in, promote, or depict any form of animal cruelty, neglect, abuse, or abandonment. This includes, but is not limited to, animal fighting, illegal breeding, or any activity that causes unnecessary pain or suffering to an animal.
• Be Respectful: Not harass, threaten, impersonate, or intimidate other users. Hate speech, discriminatory remarks, and abusive content are strictly prohibited.
• Use Lawfully: Not use the platform for any illegal or unauthorized purpose. You agree to comply with all local laws regarding online conduct and acceptable content.
• Post Responsibly: Not post spam, unsolicited commercial communications, or content that is false, misleading, defamatory, or infringes upon any third party's rights (including copyright, trademark, and privacy rights).

We reserve the right, but not the obligation, to monitor user activity and remove any content or terminate any account that violates these principles, without prior notice.

4. Specific Terms for Services

4.1. Pet Adoption Policy

PetFellow is committed to ensuring that pet adoption is accessible and free from commercial exploitation.

• Adoption is Completely Free: It is strictly prohibited for any user to request, charge, or accept any fee for the adoption of a pet through our platform. This includes, but is not limited to, "adoption fees," "rehoming fees," "transportation costs," or any other form of payment.
• No Financial Transactions for Adoption: PetFellow.org does not and will not facilitate any financial transactions related to pet adoption. Any discussion or arrangement of payments for an adoption is a direct violation of these Terms.
• Disclaimer of Liability: PetFellow acts solely as a facilitator to connect individuals wishing to rehome a pet with those wishing to adopt. We do not screen pets or individuals, nor do we verify the information provided in adoption listings. We are not a party to any adoption agreement. Users are solely responsible for conducting their own due diligence, including verifying health records and arranging safe meet-ups. PetFellow is not liable for the health, behaviour, or condition of any pet, or for any disputes that arise between parties during or after the adoption process.

4.2. E-commerce Marketplace (Pet Shops)

• Platform Only: PetFellow provides a platform for vendors to sell pet-related products. All transactions are between the buyer and the vendor.
• Vendor Responsibility: Vendors are responsible for the legality, quality, and accurate description of their products, as well as for order fulfillment and customer service.
• Payments: All payments for products are processed through secure third-party payment gateways. PetFellow does not store your credit card or financial details.

4.3. Veterinary, Caregiver, and Foster Services

• Booking Platform: PetFellow is a booking and discovery platform, not a provider of veterinary, caregiving, or foster services.
• No Endorsement: We do not endorse any specific professional or service listed on our platform. Users are responsible for verifying the credentials, licenses, and suitability of any service provider before booking.
• Disclaimer: PetFellow is not liable for the quality of care, advice, or services provided by third-party professionals, nor for any malpractice, negligence, or disputes arising from such services.

4.4. Community, Volunteer, Rescue, and Donation Services

• Community Moderation: We reserve the right to moderate all community content and remove posts or users that violate our conduct rules.
• Donations: Donations made through our platform to support animal welfare or specific crowdfunding campaigns are processed by third-party payment gateways. While we strive to partner with reputable organizations, PetFellow does not guarantee how donated funds will be used by the recipient.
• Rescue and Volunteering: PetFellow acts as a coordinator and is not liable for any incidents, injuries, or disputes that may occur during volunteer or rescue activities organized through the platform.

5. User-Generated Content

You retain all ownership rights to the content you create and post on PetFellow (e.g., text, photos, videos). However, by posting content, you grant PetFellow a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, and distribute your content in connection with providing and promoting the Services.

6. Intellectual Property

All content and materials on PetFellow.org, including our logo, design, text, graphics, and software, are the exclusive property of PetFellow or its licensors and are protected by copyright and other intellectual property laws.

7. Termination

We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice or liability, for any reason, including if you breach these Terms.

8. Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the fullest extent permitted by law, PetFellow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of Bangladesh, without regard to its conflict of law provisions.

You agree that any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the competent courts of Dhaka, Bangladesh.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make changes, we will post the revised Terms on the website and update the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
